2. Platform Description and Purpose
GoAusbildung operates as a two-sided marketplace platform that connects international students with German employers offering Ausbildung (vocational training) opportunities. We provide:

- Job Posting Platform: Employers can post Ausbildung positions; students can browse and apply
- Student Profiles: Create and manage professional profiles visible to employers
- Application Management: Submit job applications and track their status
- Direct Communication: Messaging system between students and employers
- Employer Verification: Three-tier verification system for employer credibility
- Profile Strength Scoring: 0-100 scoring system to optimize student profiles
2.2 Educational and Preparation Tools
- German Language Learning: AI-powered chat tutor, vocabulary flashcards, assessment tests, job posting reading practice
- Interview Preparation: Mock interviews with AI feedback, voice conversation practice
- CV/Resume Builder: German-standard templates with AI content generation
- Cultural Integration: City guides, workplace etiquette training, cultural scenarios
- Document Management: Secure cloud storage for certificates and documents
- Video Introduction Studio: Create video introductions for employers
2.3 Information and Guidance
- Comprehensive information about Ausbildung programs in Germany
- Visa and immigration guidance resources

3. Platform Role as Intermediary
IMPORTANT: Please read this section carefully.
3.1 What We Do
GoAusbildung is an intermediary platform that facilitates connections between students and employers. We provide technology and tools to enable job discovery, applications, and communications.
3.2 What We Do NOT Do
We explicitly do NOT:
- Act as an employer or recruitment agency: We are not party to any employment relationships
- Guarantee job placements: Application success depends entirely on employer decisions and student qualifications
- Make hiring decisions: Employers have sole discretion over whom they hire
- Enter into contracts on your behalf: Any employment agreement is directly between you and the employer
- Control employer actions: We cannot influence employer hiring practices, timelines, or decisions
- Verify job posting accuracy: Employers are responsible for the accuracy of their job listings
- Guarantee employer quality: Verification status does not constitute endorsement or warranty
3.3 No Guarantee of Outcomes
We make no guarantees regarding:
- Number of job applications you can submit
- Employer responses to your applications
- Interview invitations or job offers
- Successful employment outcomes
- Visa approval for Ausbildung programs
- Acceptance into training programs
4. User Accounts and Eligibility
4.1 Account Creation
To use marketplace features, you must create an account. When creating an account, you must:
- Be at least 18 years old (or have parental consent if under 18)
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
- Not share your account credentials with others
- Notify us immediately of any unauthorized access
4.2 Account Types
We offer two types of user accounts:
- Student Accounts: For international students seeking Ausbildung opportunities
- Employer Accounts: For German companies offering Ausbildung positions (governed by separate Employer Terms in German)
5. Student Responsibilities and Conduct
5.1 Profile Information
You agree to:
- Provide accurate, truthful, and up-to-date information in your profile
- Not misrepresent your qualifications, education, or experience
- Upload only authentic documents and certificates
- Maintain professional profile photos and content
- Update your profile when your circumstances change
5.2 Job Applications
When applying for positions, you agree to:
- Submit genuine applications for positions you are qualified for and interested in
- Not submit spam or mass applications without genuine interest
- Respond professionally to employer communications
- Withdraw applications if you are no longer interested
- Not apply using false or misleading information
- Honor any commitments you make to employers through the Platform
5.3 Prohibited Activities
You may NOT:
- Create fake profiles or use false identities
- Submit fraudulent applications or documents
- Harass, threaten, or abuse employers or other users
- Share your login credentials or access others' accounts
- Scrape, copy, or download job postings or employer data
- Attempt to circumvent the Platform to contact employers directly before proper introduction
- Use the Platform for any illegal purposes
- Interfere with Platform operations or security
- Attempt to access unauthorized areas or data
- Use automated systems (bots, scrapers) without permission
6. Acceptable Use and Prohibited Activities
This section defines acceptable and unacceptable use of the GoAusbildung marketplace platform. This Policy is designed to:
- Protect the integrity and security of the GoAusbildung marketplace
- Ensure a safe, trustworthy environment for all users
- Prevent fraud, abuse, and misuse of Platform features
- Maintain compliance with applicable laws and regulations
- Preserve the quality of connections between students and employers
6.1 Prohibited Profile Activities
You may NOT engage in the following profile-related activities:
False Identity and Misrepresentation
- Creating fake profiles using false names, identities, or credentials
- Impersonating others including real individuals, organizations, or Platform staff
- Using someone else's photos or personal information without permission
- Creating multiple accounts to circumvent restrictions, bans, or application limits
- Misrepresenting your identity including age, nationality, or residency status
Fraudulent Qualifications
- Falsifying educational qualifications including degrees, diplomas, or certificates
- Misrepresenting work experience including job titles, responsibilities, or employment duration
- Inflating German language proficiency beyond your actual level (A1-C2)
- Uploading fake documents including forged certificates, transcripts, or references
- Claiming skills or expertise you do not possess
- Fabricating professional certifications or training credentials
Document Fraud
- Submitting fraudulent identity documents including passports, national IDs, or driver's licenses
- Uploading altered or modified documents to misrepresent information
- Using documents belonging to others without authorization
- Providing fake reference letters or employment verification documents
Profile Manipulation
- Gaming the profile strength system by adding false information to increase scores
- Creating duplicate profiles to appear as multiple candidates
- Manipulating privacy settings to deceive employers about your profile visibility
- Using automation tools to artificially boost profile views or engagement
6.2 Prohibited Application Activities
You may NOT engage in the following application-related activities:
Spam and Mass Applications
- Submitting mass spam applications to numerous jobs without genuine interest or qualifications
- Using identical copy-paste applications for multiple positions without customization
- Applying to jobs you are clearly unqualified for to inflate application numbers
- Submitting automated applications using bots or scripts
- Applying to the same job repeatedly from different accounts or profiles
Application Fraud
- Submitting applications with false information about your qualifications, availability, or interest
- Using fake cover letters generated without review or customization
- Misrepresenting your job preferences including location, salary expectations, or sector interest
- Providing fake contact information to avoid employer communication
- Claiming false referrals or connections to the employer
Bad Faith Application Behavior
- Withdrawing applications repeatedly after employer engagement without valid reason
- Accepting job offers with no intention to fulfill them to block other candidates
- Manipulating application timestamps to appear as early applicants
- Circumventing application limits through multiple accounts
- Applying to collect employer data without genuine employment interest
6.3 Prohibited Communication Activities
You may NOT engage in the following communication activities:
Harassment and Abuse
- Harassing or threatening employers through messages, emails, or other communications
- Sending abusive or offensive language in any Platform communication
- Stalking or persistently contacting employers after being asked to stop
- Making discriminatory remarks based on race, religion, gender, nationality, or other protected characteristics
- Using hate speech or inflammatory language in any context
Spam and Unsolicited Messages
- Sending unsolicited marketing messages or promotional content to employers
- Spamming employers with irrelevant messages unrelated to job applications
- Mass messaging employers with identical or templated content
- Sharing external links to malicious websites or phishing pages
Off-Platform Recruitment
- Sharing contact information before proper introduction to circumvent the Platform
- Attempting to move conversations off-platform to avoid monitoring
- Soliciting direct payment from employers for visa fees, training, or services
- Offering bribes or kickbacks to employers for hiring consideration
Impersonation and Deception
- Impersonating GoAusbildung staff or administrators in communications
- Phishing or social engineering attempts to obtain employer credentials or sensitive information
- Falsely claiming official endorsement or partnership with GoAusbildung
- Using fake email addresses that appear to be from GoAusbildung or employers
6.4 Prohibited Data Activities
You may NOT engage in the following data-related activities:
Data Scraping and Harvesting
- Scraping or copying job postings for republication on other platforms
- Downloading employer data in bulk without explicit permission
- Using automated bots or scrapers to extract Platform content
- Data mining or harvesting user profiles, job listings, or employer information
- Reverse engineering Platform features to access underlying data
Unauthorized Access
- Accessing other users' accounts without authorization
- Sharing login credentials with third parties or other users
- Attempting to bypass authentication systems or security measures
- Using stolen or compromised credentials to access accounts
- Accessing restricted areas of the Platform not intended for your user type
Data Misuse
- Using employer data for competitive purposes or business intelligence
- Selling or sharing employer contact information with third parties
- Creating databases of job postings without permission
- Republishing Platform content on external websites or services
6.5 Prohibited Marketplace Activities
You may NOT engage in the following marketplace activities:
Fraudulent Employment Schemes
- Submitting fake job applications to collect employer data or conduct market research
- Accepting job offers with no intention to work to prevent other candidates from being hired
- Requesting money from employers for visa fees, training fees, or relocation costs before employment
- Offering bribes or kickbacks to employers in exchange for hiring consideration
- Creating fraudulent employment schemes or pyramid structures
Platform Misuse
- Using the Platform for non-Ausbildung purposes including full-time employment, freelance work, or internships unrelated to vocational training
- Posting or soliciting services unrelated to Ausbildung opportunities
- Using the Platform for advertising or promoting external products, services, or businesses
- Conducting surveys or research without explicit permission from GoAusbildung
Competitive Intelligence
- Creating accounts to monitor competitors or collect competitive intelligence
- Using the Platform to recruit for competing platforms or services
- Copying Platform features or design for competitive purposes
6.6 Prohibited Technical Activities
You may NOT engage in the following technical activities:
Security Violations
- Hacking or attempting to breach security systems including firewalls, authentication, or encryption
- Introducing viruses, malware, or malicious code to the Platform
- DDoS attacks or attempts to overload servers with excessive requests
- Exploiting platform vulnerabilities for personal gain or to harm the Platform
- Bypassing security measures including rate limits, CAPTCHAs, or access controls
Unauthorized API Access
- Accessing Platform APIs without authorization or proper credentials
- Exceeding API rate limits intentionally to disrupt service
- Using Platform APIs for unauthorized purposes including data scraping or competitive analysis
- Reverse engineering API endpoints to access restricted functionality
System Interference
- Interfering with Platform operations including server performance or user experience
- Attempting to disable or circumvent Platform features, analytics, or tracking
- Modifying or tampering with Platform code through browser extensions or scripts
- Creating fake traffic or engagement to manipulate analytics or metrics
6.7 Prohibited Content
You may NOT upload, post, or share the following content:
Illegal Content
- Content promoting illegal activities including drug use, weapon sales, or human trafficking
- Child exploitation material or content sexualizing minors
- Hate speech or extremist content promoting violence or discrimination
- Content violating intellectual property rights including copyrighted material, trademarks, or trade secrets
- Counterfeit documents or credentials including fake degrees or certificates
Inappropriate Content
- Sexually explicit or pornographic content in profiles, applications, or communications
- Violent or disturbing content including graphic images or videos
- Misleading or deceptive content designed to trick or deceive users
- Spam or malicious links leading to phishing sites or malware
Offensive Content
- Discriminatory content based on race, religion, gender, sexual orientation, nationality, disability, or other protected characteristics
- Harassment or bullying content targeting specific individuals or groups
- Defamatory or libelous content making false claims about individuals or organizations
- Offensive language or slurs in any Platform communication
6.8 Marketplace Integrity Violations
You may NOT engage in activities that undermine marketplace integrity:
Fake Reviews and Testimonials
- Creating fake reviews or testimonials for employers or the Platform
- Soliciting or purchasing fake reviews to manipulate ratings
- Leaving malicious reviews to harm employers or competitors
- Review bombing or coordinated negative reviews to damage reputations
Score Manipulation
- Manipulating profile strength scores through false information or automated tools
- Exploiting scoring algorithms to gain unfair advantages
- Creating fake engagement to boost profile visibility artificially
Marketplace Fraud
- Creating fake employer accounts to collect student data or conduct scams
- Submitting fake job postings to test the Platform or collect applications
- Collusion between students and employers to circumvent Platform policies or fees
- Vote manipulation or rating abuse to influence Platform rankings
7. Community Standards and Guidelines

These Community Guidelines help us maintain a positive, respectful, and productive environment for everyone. By using GoAusbildung, you're joining a community that values honesty, respect, professionalism, and inclusivity.
7.1 Be Authentic and Honest
Authenticity is the foundation of trust in our community. When you represent yourself truthfully, you create meaningful connections with employers who are the right fit for you.
What this means:
- Truthful Profiles: Represent your education, experience, and skills accurately. Embellishing or falsifying information hurts your credibility and wastes everyone's time.
- Genuine Documents: Upload only authentic certificates, qualifications, and references. Never submit forged or altered documents.
- Honest Language Proficiency: Be truthful about your German language level. Overstating your abilities can lead to difficulties in interviews and training.
- Authentic Applications: Apply only to jobs you're genuinely interested in and qualified for. Mass-applying without reading job descriptions hurts your chances.
- Disclose Conflicts: If you have any conflicts of interest or special circumstances, be upfront about them.
Remember: Employers value honesty over perfection. They'd rather know your true starting point than discover inconsistencies later.
7.2 Be Professional
Professionalism shows employers you're serious about your career and ready for the workplace. Small details make a big difference.

- Profile Photos: Use a clear, professional headshot. Save casual selfies and party photos for social media.
- Professional Content: Write your bio, cover letters, and messages in a business-appropriate tone. Proofread before submitting.
- Respectful Communication: Be polite and courteous in all messages, even if you receive a rejection.
- Timely Responses: Reply to employer messages within 48 hours. If you need more time, send a brief acknowledgment.
- Honor Commitments: If you accept an interview invitation, show up on time. If you accept a job offer, follow through unless extraordinary circumstances arise.

7.3 Be Respectful

- Ask Questions Politely: If you need clarification about a job posting or application process, ask respectfully and specifically.

7.5 Protect Privacy
Privacy and data protection are fundamental rights. We take them seriously, and we ask you to do the same.

- Employer Confidentiality: If an employer shares confidential business information during your application process, keep it confidential.
- Report Privacy Violations: If you see someone sharing private information inappropriately, report it to us immediately at community@goausbildung.com.
- Use Platform Messaging: Don't pressure employers or students to move conversations to personal email or phone numbers. Our platform messaging keeps everyone safe.

- Provide Interview Feedback: If requested, share constructive feedback about your interview experience to help employers improve their process.
- Respect Resources: Employers often have limited HR capacity. Make every interaction count by being prepared and professional.

7.8 Use Platform Features Properly
Our platform offers many tools to help you succeed. Using them properly improves your experience and helps us serve you better.

- Keep Information Updated: Update your availability date, location preferences, and German level as they change.

- Participate in Surveys: When we ask for feedback, your input helps us improve the platform for everyone.

7.9 Report Violations
Keeping our community safe and respectful is everyone's responsibility. If you see something concerning, please report it.
What to Report:
- Harassment or Bullying: Threatening, abusive, or intimidating behavior toward any community member
- Discrimination: Discriminatory language or behavior based on nationality, race, gender, religion, or other protected characteristics
- Fraud or Scams: Fake job postings, phishing attempts, requests for money, or other fraudulent activity
- Inappropriate Content: Sexually explicit material, violence, hate speech, or other offensive content
- Privacy Violations: Sharing others' personal information without consent
- Spam: Repeated unsolicited messages, promotional content unrelated to Ausbildung
How to Report:
Email us at community@goausbildung.com with:
- Description of what happened
- Link to the profile, job posting, or message involved
- Screenshots if helpful (remove personal information from screenshots)
- When it occurred
Confidentiality: All reports are reviewed confidentially by our team. We investigate thoroughly and take appropriate action, which may include warnings, account restrictions, or permanent removal.
7.10 Consequences of Violations
We believe in giving everyone the opportunity to learn and grow. However, we also take violations seriously to protect our community.
Progressive Enforcement:
- Friendly Reminder (Minor Issues): For first-time minor violations, we'll send a friendly reminder about the guidelines.
- Formal Warning (Repeated Violations): Repeated minor violations or first-time moderate violations receive a formal warning with documentation.
- Temporary Restrictions (Serious Violations): Serious violations may result in temporary restrictions on messaging, applications, or platform access (7-30 days).
- Permanent Account Closure (Severe Violations): Severe violations (fraud, harassment, discrimination, privacy breaches) may result in immediate permanent account closure.

- Harassing or threatening other users
- Operating fraudulent employer accounts or posting fake jobs
- Sharing others' private information publicly
- Using the platform for illegal activities
8. Profile Visibility and Data Sharing
8.1 Profile Privacy Settings
You have control over your profile visibility through our privacy settings. You can choose:
- Public Profile: Visible to all employers on the platform
- Private Profile: Visible only when you apply to jobs
- Granular Controls: Show/hide specific profile sections (experience, skills, documents, etc.)
8.2 Data Shared with Employers
When you apply for a job, the following information is shared with the employer:
- Your profile information (based on your privacy settings)
- Application materials (CV, cover letter, video introduction)
- Uploaded documents and certificates
- German language proficiency level
- Education and work experience
- Contact information (if you choose to share it)
8.3 Employer Access
Employers can:
- View profiles of students who apply to their jobs
- Search and browse public student profiles (if you have public visibility enabled)
- Download application materials you submit
- Contact you through the Platform messaging system
9. Employer Verification System
9.1 Verification Tiers
Employers on our platform are categorized into three verification tiers:
- Tier 1 (Unverified): Newly registered employers who have not completed verification
- Tier 2 (Verified): Employers who have completed profile requirements and passed manual admin verification
- Tier 3 (Trusted): Long-standing verified employers with proven track record
9.2 Verification Disclaimer
IMPORTANT: Verification status indicates that an employer has completed our verification process. It does NOT:
- Guarantee employer legitimacy or quality
- Constitute our endorsement of the employer
- Warrant employment conditions or workplace quality
- Validate legal compliance with labor laws
- Guarantee job posting accuracy
You should conduct your own due diligence before accepting any employment offer.
10. Automatic Translation Services
Job postings on our platform are originally created in German by employers and may be automatically translated to English using AI-powered translation services (Google Gemini 2.5 Flash).
10.1 Translation Accuracy
While we strive for accuracy, automated translations may:
- Contain errors or inaccuracies
- Lose nuance or context from the original German text
- Misinterpret technical or industry-specific terms
- Not perfectly reflect the employer's intent
10.2 Your Responsibility
You should:
- Verify important information directly with employers
- Ask for clarification if any job posting details are unclear
- Not rely solely on translated content for critical decisions
- Understand that the German version is the authoritative version
11. Service Fees and Payment
11.1 Current Pricing Model
The GoAusbildung marketplace is currently FREE for students. This includes:
- Creating and managing your profile
- Browsing and applying to unlimited job postings
- Using the messaging system
- Accessing educational tools and resources
11.2 Premium Features (Optional)
Certain premium features may require payment:
- Advanced German language assessment credits
- Voice conversation practice credits (ElevenLabs)
- Premium CV templates and exports
- Consultation services (if requested)
11.3 Future Pricing Changes
We reserve the right to introduce fees for certain features in the future. If we do:
- We will provide at least 30 days' notice before implementing fees
- Existing users may receive grandfathered pricing
- Core marketplace features will remain accessible
- All fees will be clearly disclosed before purchase
11.4 Payment Terms
For any paid services:
- All fees are stated in the currency shown at purchase
- Payment is required before service delivery
- We accept major credit cards and payment methods shown on our platform
- Taxes may apply and will be calculated at checkout
- Receipts are available in your account
12. Refund Policy

- Marketplace access (free features): No refunds applicable as no fees are charged
- Premium features: Refunds available within specified timeframes based on service type
- Unused credits: May be valid for 12 months from purchase

13. Intellectual Property Rights

All content on our Platform, including but not limited to:
- Website design, layout, and user interface
- GoAusbildung logo, branding, and trademarks
- Software, algorithms, and technology
- Educational content and resources
- Blog posts, articles, and guides
- Graphics, images, and multimedia
are the property of Qogent Global or its licensors and are protected by copyright, trademark, and other intellectual property laws.
13.2 User-Generated Content
Regarding content you create and upload (CVs, cover letters, profiles, videos, documents):
- You retain ownership of your content
- You grant us a license to use, display, and share your content on the Platform for the purpose of providing marketplace services
- We may use anonymized data for analytics and platform improvement
- We may showcase anonymized success stories and testimonials (with your consent)
- You represent and warrant that you have the right to upload all content you submit
13.3 Employer Content
Job postings, company descriptions, and other employer-generated content:
- Remain the intellectual property of the respective employers
- Are licensed to us for display on the Platform

15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

GoAusbildung and its affiliates, directors, officers, employees, and agents shall NOT be liable for:
- Employment Outcomes: Whether employers hire you, interview you, or respond to your applications
- Employer Actions: Conduct, decisions, or policies of employers on the Platform
- Job Posting Accuracy: Errors, inaccuracies, or misleading information in employer job postings
- Employment Contracts: Terms, conditions, or disputes between you and employers
- Visa Decisions: German visa approval or denial, or immigration outcomes
- Training Program Acceptance: Admission or rejection from Ausbildung programs
- Translation Accuracy: Errors in automated job posting translations
- Third-Party Services: Actions or omissions of third-party service providers
- Platform Availability: Service interruptions, downtime, or technical issues
- Data Loss: Loss or corruption of your data (though we implement backup systems)
- Security Breaches: Unauthorized access to your account or data (though we implement security measures)
- Other Users: Actions, content, or conduct of other Platform users
15.2 Indirect and Consequential Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

15.3 Maximum Liability

17. Indemnification
You agree to indemnify, defend, and hold harmless GoAusbildung, Qogent Global, and our affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of another party
- Your content or application materials
- Your conduct on the Platform
- Your employment relationship with any employer
18. Service Modifications and Termination
